Who we are

Modway Communications ("we," "us") sells new, new old stock, and refurbished Motorola two-way radios through modwaycommunications.com. This policy explains what personal information we collect, how we use it, and the rights you have, including under the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) and the California Online Privacy Protection Act (CalOPPA).

Information we collect

  • Identifiers and contact details: name, email address, phone number, and shipping address you enter in our contact, request-info, or order request forms.
  • Order information: the radios and accessories you request, quantities, notes, and programming details (such as frequencies and channel names).
  • Messages: anything you write to us in a form, email, call, or text.
  • Device and usage data: basic technical data such as browser type, pages visited, and approximate location derived from IP address, collected automatically when you visit.
  • Cart contents: stored only in your own browser until you submit a request.

We do not collect payment card details on this website. Payment is handled by invoice outside the site.

We do not knowingly collect information from children under 16.

How we use it

  • To respond to your questions and information requests.
  • To review order requests, prepare and send invoices, program radios, and ship orders.
  • To handle warranty claims and returns.
  • To keep the site secure and prevent spam or fraud.
  • To meet legal, tax, and accounting obligations.

Sharing

We do not sell or share your personal information for money or for cross-context behavioral advertising, and we have not done so in the past 12 months. We disclose information only to service providers who help us run the business — website hosting and data storage, invoicing and accounting software, and shipping carriers — and only as needed to provide our services, or when required by law.

How long we keep it

We keep inquiry records for up to 2 years and order and invoice records for as long as tax and accounting law requires (generally 7 years), then delete them.

Your California privacy rights

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, and disclose.
  • Access a copy of your personal information.
  • Delete personal information we hold about you, subject to legal exceptions.
  • Correct inaccurate personal information.
  • Opt out of the sale or sharing of personal information (we do neither).
  • Limit use of sensitive personal information (we do not collect any for that purpose).
  • Not be discriminated against for exercising any of these rights.

To make a request, email dsnapp@modwayps.com or call (209) 594-5451. We will verify your identity by matching details you gave us, and respond within 45 days. You may use an authorized agent with your written permission.

Do Not Track and Global Privacy Control

We do not track visitors across other websites. We honor Global Privacy Control (GPC) browser signals as a request to opt out of sale or sharing. Our site does not change its behavior in response to "Do Not Track" signals because we do no cross-site tracking.

Security

Submissions are stored in a secured database with access restricted to the business owner. No method of transmission or storage is completely secure, but we take reasonable steps to protect your information.

Changes and contact

We will post any changes here and update the date above. Questions? Contact Modway Communications at dsnapp@modwayps.com or (209) 594-5451.
